User Agreement

THE SERVICE

We advise using the Service to send money to friends and family, and therefore discourage using it for transactions with unfamiliar recipients.

The Service facilitates international money transfers from the United States to other countries where Hong Lan operates. A "Sender" uses the Service to initiate money transfers, while a "Recipient" receives funds through the Service. A "Transaction" denotes an order to transfer money via the Service. The "Transaction Amount" refers to the sum in US dollars that the Sender submits to Hong Lan for transmission to the Recipient. The "Payout Amount" signifies the amount disbursed to the Recipient.

ELIGIBILITY FOR THE SERVICE

•             Age and Capacity: You must be at least eighteen (18) years old to create an account, access, or use the Service as a Sender. You must also have the legal capacity to enter into binding contracts under applicable law. Additional restrictions may apply.

•             Authorization: You may not submit or receive a Transaction on behalf of any other individual.

•             U.S. Residence Requirement: The Service is only available to residents of the United States.

•             Offer and Acceptance: By submitting a Transaction, you are making a request for us to process your Transaction. This request represents an offer that we may accept or reject at our sole discretion.

•             U.S. Registration: Hong Lan Services Inc. is licensed to provide the Service exclusively within the United States. Therefore, the Service may not be accessible or available for use in countries outside of the United States.

•             Single Account Policy: Senders are permitted to maintain only one active account. If we determine that a Sender has multiple accounts, we reserve the right to merge or terminate one or more accounts, restrict the Sender's use of the Service, or discontinue their access to the Service altogether.

PAYING FOR THE SERVICE

•             Service Fees: By submitting each Transaction, you agree to pay us a service fee ("Service Fee") in addition to the Transaction Amount. Payment in US dollars is due at the time the transaction is submitted for processing. If your transaction results in costs being incurred by Hong Lan, you agree to reimburse us for all such fees.

•             Payment Authorization: To facilitate the processing of your transaction, you authorize us to charge any of the payment instruments linked to your payment profile ("Payment Instrument"), which may include credit cards, debit cards, or bank accounts. In the event of payment failure, you authorize us to retry using the same Payment Instrument multiple times. You confirm that you are an authorized and lawful user of the Payment Instrument(s).

•             Additional Charges: We are not liable for any fees that financial institutions associated with your Payment Instruments may impose. For example, some credit card issuers may consider using your credit card for our Service as a "cash advance" and may apply additional fees and interest charges. Hong Lan bears no responsibility for any such fees or similar charges imposed by your bank, debit/credit card issuer, or other providers. 

RECEIVING A REMITTANCE

•             Service Providers: We collaborate with local banks and other third-party outlets (each, a "Service Provider") to facilitate funds availability for Recipients. As a Sender, you authorize your Recipient to act as your agent for receiving funds transmitted through the Service. While we strive to maintain up-to-date information on our website regarding the location, availability, and operating hours of our Service Providers, we are not liable for any inaccuracies or omissions on the website.

•             Verification: Recipients must verify their identities before receiving funds by presenting valid identification. Additionally, Recipients may need to provide a reference number or a similar identifier associated with their Transactions.

IMPORTANT SERVICE RESTRICTIONS

1.            General: We reserve the right to refuse any Transaction or limit the transfer amount, either on a per transaction basis or aggregated across accounts. These limits may apply to individual accounts or linked accounts. We also reserve the right to modify or discontinue all or part of the Service at any time.

2.            Delays: Your Transaction may be delayed while we verify your identity, validate your Payment Instruments, and ensure compliance with applicable laws or manage financial risk. In certain circumstances, you may be entitled to a refund, and you can cancel your Transaction while it is pending.

3.            Commercial Transactions: The Service should only be used to send money to individuals you know. We are not responsible for the quality or delivery of goods or services purchased using the Service. You acknowledge that using the Service for commercial transactions is at your own risk.

4.            Unauthorized Transactions: You may not use the Service for any purpose that violates this Agreement or applicable laws, rules, or regulations. Prohibited activities include, but are not limited to, sexually-oriented materials or services, gambling activities, fraud, money laundering, funding of terrorist organizations, or transactions involving tobacco, firearms, prescription drugs, or other controlled substances. Using the Service for illegal activities will result in reporting to law enforcement.

5.            Ineligibility: Your Payment Instrument must be issued by a U.S. financial institution. We may refuse Transactions from certain Senders or to certain Recipients listed on government-issued watch lists, such as the Specially Designated Nationals list and Non-cooperative Countries and Territories list.

6.            No Changes: Once submitted for processing, Transaction details generally cannot be modified. It is your responsibility to ensure accuracy in your Transaction details.

7.            Restricted Activities: In connection with your use of our website or the Service, you agree not to:

•             Breach this Agreement or any other agreement with us.

•             Provide false, inaccurate, or misleading information.

•             Refuse to cooperate in an investigation or provide confirmation of your identity.

•             Use an anonymizing proxy.

•             Obtain a cash advance from your credit card or assist others in doing so.

•             Use any automated device or manual process to monitor or copy our website or Transactions.

8.            Transactions to India: Transactions to India are processed under the Rupee Drawing Arrangements (RDA) established by the Reserve Bank of India. Commercial use of the Service or contributions to charitable organizations are prohibited under these arrangements.

HOW AND WHY WE COLLECT PERSONAL INFORMATION

1.            Privacy Policy: By accepting this Agreement, you acknowledge and consent to Hong Lan’s Privacy Policy.

2.            Customer Identification Program: U.S. law mandates that we collect, verify, and record information about you. We may request nonpublic, personal, identifying information from you. Additionally, we may lawfully gather information about you from other sources, including non-personal identifying information obtained during your website visits. Please refer to our Privacy Policy for more details.

3.            Government Disclosures: We may disclose information about you and your Transactions to government authorities and law enforcement agencies, as outlined in our Privacy Policy.

4.            Verification of Information: You authorize us to conduct necessary inquiries, either directly to you or through other means, to validate the information you provide. This process may involve requesting additional information from you, verifying ownership of your email address or financial instruments, checking your details against third-party databases, or utilizing other sources for verification purposes.

HOW WE USE YOUR PERSONAL INFORMATION

Authorize to Use Data

By using our services, the customer agrees and authorizes us to collect, use, and store their personal information for the following purposes:

Marketing and Advertising: We are authorized to use the customer's personal information to send promotional materials, offers, and advertisements tailored to their preferences. This includes personalized content and targeted advertising based on the customer's interactions with our services.

Promotional Activities: We are also authorized to use the customer's information to notify them about special promotions, events, surveys, or contests that we believe may be of interest to them.

Customer's Consent

By agreeing to this User Agreement, the customer confirms that they have read, understood, and agreed to the use of their personal information for the purposes mentioned above. The customer may opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in our communications or by contacting us directly. 

ERROR RESOLUTION, CANCELLATION, AND REFUNDS

1.            Error Resolution: If you encounter any issues with the Service, please notify us promptly. You can reach us via email at customerservices@goitien247.com or by calling (888)-880-8345.

2.            Refunds: You have the option to cancel your transaction at any time before it is completed. Completion occurs when your recipient claims the money you sent, whether through cash pick-up, home delivery, or bank account deposit. Upon receiving a cancellation request, we may verify with our Service Providers to confirm if the transaction has been completed prior to initiating a refund.

The Transaction Amount cannot be refunded after completion. However, if you are dissatisfied with our service for any reason, we will refund the fee amount. All refunds will be credited to the same Payment Instrument used for the Transaction. Refunds are processed in U.S. dollars and are not adjusted for changes in the value of the U.S. dollar or foreign currency from the time of the Transaction submission. Please note that residents of certain jurisdictions may have specific refund rights and complaint procedures. 

HONG LAN’S INTELLECTUAL PROPERTY

You acknowledge that the Service, including the content on this website, such as text, graphics, logos, and images, as well as all other intellectual property rights owned by Hong Lan, Inc. ("Hong Lan Intellectual Property"), are exclusively owned by Hong Lan.

 

You agree not to display, use, copy, or modify the Hong Lan Intellectual Property in any manner. You are authorized solely to view and retain a copy of the pages of this website for your personal, non-commercial use. Additionally, you agree not to: (i) use any automated device such as a robot, spider, or scraper to access the Service; (ii) remove or alter any copyright, trademark, or other proprietary notice displayed on this website (or printed pages thereof); or (iii) violate Hong Lan's or any third party's copyright, patent, trademark, trade secret, or other intellectual property rights, or rights of publicity or privacy.

If you provide us with any suggestions, feedback, reviews, or other input ("Customer Input") related to our Services, we (and our affiliated entities) will own all rights, title, and interest in and to the Customer Input, even if you designate the Customer Input as confidential. We and our affiliated entities will have the right to use the Customer Input without restriction, including for marketing or business purposes. You transfer to us all rights, title, and interest in and to the Customer Input and agree to provide us with any assistance necessary to document, perfect, and maintain our rights in the Customer Input. 

 

 

 

DISCLAIMER OF WARRANTIES

While we endeavor to process Transactions promptly, we cannot guarantee the time required for processing due to numerous factors beyond our control. The Service operates subject to these external influences. Certain jurisdictions may not permit the exclusion of implied warranties, so the above disclaimer might not apply to you. This disclaimer grants you specific legal rights, and you may possess additional rights that vary from state to state. Nonetheless, you may have recourse to a refund as explicitly detailed herein. In accordance with federal law, if the Payout Amount is not accessible to the Recipient by the indicated availability date on your Transaction receipt, you can use the error resolution procedure outlined in Section 7 above to inform us of the matter, potentially entitling you to remedies under federal law, including a refund of our Service Fee.

E-SIGN DISCLOSURE & CONSENT NOTICE

By accepting this User Agreement as indicated below, you consent to receive and access disclosures, notices, statements, and other communications ("Communications") from Hong Lan electronically via any of the following methods:

Text messages to your mobile phone number associated with your account (which may include a link to Communications on our website or in our Service);

Emails to your email address associated with your account;

Notifications from our web or mobile application.

Receipt of Communications through any of these methods will constitute proper notice to you under applicable law. You acknowledge that Communications may include, but are not limited to, the following:

Our website, Privacy Policy, or User Agreement ("Legal Policies and Agreements");

Disclosures and/or amendments provided under our Legal Policies and Agreements;

Activity and any other information concerning your use of our Service and account;

Receipts, confirmations, status updates, authorizations, and transaction history for your account;

Communications concerning the resolution of any reported errors; and

Communications required or permitted by law or regulation.

YOUR RIGHT TO REVOKE CONSENT

As we primarily communicate electronically, your consent to receive Communications electronically is necessary to establish a Hong Lan account and utilize our Service. You have the right to withdraw this consent to receive all Communications electronically by contacting our Customer Service via the Contact Us page on our website. If you do not provide or withdraw your consent to receive Communications electronically, we will be unable to establish an account for you, or we may terminate, suspend, or decline to provide the Service, unless you are entitled under applicable law to receive non-electronic Communications.

RECEIVING TEXTS AND EMAILS

To receive Communications, you must ensure that the primary mobile phone number and/or email address you provide us is valid and current, and capable of receiving texts or email messages containing Communications, including attached electronic documents. You agree that these Communications, including any attached documents, are accessible for viewing, storing, or printing by you. If your email address changes, you agree to promptly update it in your account settings.

You acknowledge that our ability to notify you about the availability of Communications depends on the accuracy of the mobile phone number and email address in our records. If we send you a Communication and you are unable to receive it due to inaccurate or blocked contact information, or if the Communication is otherwise unavailable to you, we will consider the Communication as provided to you. However, if your mobile phone number or email address becomes invalid, we reserve the right to treat your account as inactive or take other actions outlined in this Agreement. Until you update your mobile phone number or email address in your account, you will not be able to conduct any transactions.

You acknowledge and agree that we are responsible for sending Communications to you electronically via email or text to the address in your Account profile or through the Service. We are not liable for any delay or failure in your receipt of these email or text notices, regardless of whether you choose to view the Communication, except as provided for in your right to revoke your consent to receive Communications electronically.

SECURITY

Ensuring your security is a top priority at Hong Lan, and we employ a range of security measures to safeguard your information. We strongly advise you to exercise caution before transferring money to individuals you are not familiar with. Specifically, be wary of deals or offers that appear overly advantageous. LANGUAGE

This Agreement is written in English, and translations into other languages may be provided. You agree that in case of any discrepancy between the English version of the Agreement and its translated versions in any dispute related to this Agreement, the English version shall prevail.
